If You’re Arrested, Do This!

Getting arrested is one of the most frightening experiences a person can face. Whether it’s your first time or not, being placed in handcuffs and taken into custody can feel like your life is spinning out of control. But here’s the truth: what you do in those first few minutes can make or break your case. If you ever find yourself in this situation, do this!
1. Stay Calm and Say As Little As Possible
The police are trained to observe your behavior and gather information from the moment they approach you. If you panic, argue, or try to explain yourself, you may accidentally say something that can be used against you later, even if you’re innocent.
What to do: Stay calm. Take deep breaths. Do not resist, run, or argue. Most importantly, invoke your right to remain silent.
2. Don’t Try to Explain or Talk Your Way Out of It
Many people think that if they just tell their side of the story, the officer will let them go. That rarely happens. In fact, the more you talk, the more likely you are to give law enforcement information they can use against you in court.
What not to do: Don’t admit to anything, don’t lie, and don’t volunteer information. The police are not on your side. Their goal is to gather evidence, not to clear your name.
3. Ask for a Lawyer Immediately
This is your most powerful right and your best protection. Once you request a lawyer, questioning must stop. Do not let the police pressure you into “just answering a few questions.” Once you ask for a lawyer, remain silent.
What to do: Be polite but firm. If they say it will go easier on you if you cooperate, remember that’s a tactic. You are not required to speak without your lawyer present, and you shouldn’t.
4. Don’t Talk About Your Case on the Phone or in Jail
Jail calls are recorded. Everything you say can be used against you. Don’t discuss the case, your charges, or your side of the story with anyone.
